Scope of Services
Services Provided: This Agreement governs the provision of services by ReallyGoodHost.com, including but not limited to web hosting, domain registration, and related services (“Services”).
Incorporated Policies: The Privacy Policy, Data Processing Policy, Acceptable Use Policy (“AUP”), and any other related policies are integral parts of this Agreement. By using our Services, you agree to abide by the terms and conditions set forth in these policies.
Account Setup and Management
Account Eligibility: You must be at least 18 years old or have legal parental or guardian consent to use our Services. By registering for our Services, you warrant that the information provided is accurate, complete, and up to date.
Account Security: You are responsible for maintaining the security and confidentiality of your account credentials. You agree to notify us immediately in the event of any unauthorized access or security breach related to your account.
Content Responsibility: You are solely responsible for the content you store on and transmit through our servers. You must ensure that your content complies with all applicable laws and regulations, as well as our Acceptable Use Policy. We do not monitor the content hosted on our servers and disclaim all liability for such content.
Use of Services
Prohibited Activities: You agree not to use our Services for any unlawful purpose or any activity prohibited under this Agreement, including but not limited to hosting, storing, or transmitting unlawful, harassing, abusive, defamatory, obscene, or otherwise objectionable content; engaging in activities that disrupt or interfere with the Services, such as spamming, phishing, or distributing malware; or unauthorized access to or use of data, systems, networks, or accounts.
Resource Usage: Customers must use resources in a manner consistent with the intended purpose of our Services. Excessive resource usage that disrupts the performance of our Services for other customers may result in the suspension or termination of your account.
Payments and Billing
Payment Obligations: You agree to pay all fees and charges associated with your account on time. Fees for Services are due in advance and are non-refundable unless otherwise specified in this Agreement.
Late Payments: If your payment method fails or your account becomes overdue, we reserve the right to suspend or terminate your account until all outstanding balances are paid in full.
Price Changes: We reserve the right to modify our pricing at any time. Any price changes will be communicated at least 30 days in advance before taking effect.
Domain Registration
Domain Registration Services: We offer domain registration services through third-party registrars. By registering a domain through us, you agree to comply with the terms and conditions of the relevant registrar.
Domain Renewal: It is your responsibility to ensure that your domain registration is renewed prior to its expiration date. We are not liable for any loss or damages resulting from the failure to renew a domain.
Cancellations and Refunds
Cancellation Policy: You may cancel your account at any time by providing written notice to our support team. Upon cancellation, all data associated with your account will be deleted.
Refund Policy: Refunds are only available during the first 45 days of service. After 45 days, no refunds will be issued. Domain registration fees and additional service fees are non-refundable. If your account violates our Acceptable Use Policy, you will not be eligible for a refund, and any payments made will be considered liquidated damages.
Service Uptime and Guarantee
Uptime Guarantee: We guarantee 99.9% uptime for our hosting services. If we fail to meet this guarantee, you may request a service credit for the affected month.
Service Interruptions: We are not responsible for service interruptions due to circumstances beyond our control, including but not limited to natural disasters, acts of war, or third-party failures.
Limitation of Liability
No Warranty: Our Services are provided “as is” without any warranties, express or implied. We do not guarantee that our Services will be error-free, secure, or uninterrupted.
Limitation of Liability: To the maximum extent permitted by law, ReallyGoodHost.com shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, revenue, or data.
Indemnification
You agree to indemnify, defend, and hold harmless ReallyGoodHost.com, its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses arising from your use of our Services or your breach of this Agreement.
Dispute Resolution and Arbitration
Arbitration Agreement: Any dispute, controversy, or claim arising out of or relating to this Agreement or its breach, termination, enforcement, interpretation, or validity shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association (AAA).
Arbitration Location: The arbitration shall be conducted in West Palm Beach, Florida, unless both parties agree otherwise.
Arbitration Procedures: The arbitration will be conducted by a single arbitrator applying the laws of the State of Florida consistent with the Federal Arbitration Act. The arbitrator’s decision shall be final and binding, and may be entered as a judgment in any court of competent jurisdiction.
Class Action Waiver: You agree that arbitration will be conducted on an individual basis only, and not in a class, consolidated, or representative action. The arbitrator may not consolidate more than one person’s claims or preside over any form of a class proceeding.
Modifications to the Agreement
We reserve the right to modify this Agreement at any time. Changes will be effective immediately upon posting on our website. Your continued use of our Services following any changes constitutes your acceptance of the new terms.
Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles. Any disputes arising under or in connection with this Agreement that are not subject to arbitration shall be resolved exclusively in the state or federal courts located in Miami, Florida.
